Submission Terms and Conditions - The Final Word

 

Effective Date: March 15, 2026

These Submission Terms and Conditions (the "Terms") govern the submission of ideas, pitch decks, videos, and other creative materials (collectively, "Submissions") to The Final Word ("Company," "we," "us," or "our") via our website (https://www.thefinalword.store/), Wix forms, or other designated communication channels. By submitting your materials, you ("Submitter" or "you") agree to be legally bound by these Terms.

1. NO CONFIDENTIALITY OR FIDUCIARY RELATIONSHIP

You acknowledge and agree that your Submission is submitted on a non-confidential and non-proprietary basis. No confidential, fiduciary, or implied-in-law relationship is created between you and The Final Word by virtue of your Submission. You understand that The Final Word and its affiliates are constantly engaged in the creation, development, and production of creative content, including branding, web design, and multimedia projects, and that materials similar or identical to your Submission may already be under consideration or in development by us.

2. OWNERSHIP AND LICENSE

2.1 Submitter Ownership: You represent and warrant that you are the sole creator and owner of the Submission, or that you have obtained all necessary rights, licenses, and permissions to grant the rights herein.
2.2 Grant of License (Review Purposes Only): By providing a Submission, you grant The Final Word a non-exclusive, worldwide, royalty-free license to access, download, store, reproduce, and internally use the Submission solely as reasonably necessary to (i) review and evaluate the Submission, (ii) communicate with you about the Submission, and (iii) administer our submission intake and review process (including sharing internally with our team and professional advisors under obligations of confidentiality as appropriate). This license does not grant The Final Word any ownership interest in your Submission.
2.3 Future Agreements / No Promise of Funding or Production: Nothing in these Terms shall be construed as a promise of employment, compensation, funding, optioning, acquisition, distribution, or production. If The Final Word expresses interest in pursuing your Submission for any commercial use or production (including Writer-for-hire or Producer-for-hire services, content production, or platform features), a separate, formal written agreement must be executed by both parties before any such use.

3. REPRESENTATIONS AND WARRANTIES

You represent and warrant that:

  • The Submission is your original work and does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party.

  • You have the full right and authority to enter into this agreement.

  • The Submission does not contain any defamatory, libelous, or unlawful material.

4. RELEASE; WAIVER OF INTELLECTUAL PROPERTY DISPUTES FOR SIMILAR CONCEPTS

You acknowledge that The Final Word may have already developed, may be developing, or may in the future develop materials, projects, concepts, formats, stories, designs, or other works that are similar or identical to your Submission. To the fullest extent permitted by law, you hereby release and agree not to assert against The Final Word, its officers, employees, contractors, and affiliates any and all claims, demands, or causes of action—whether known or unknown—arising out of or related to The Final Word's development, production, exploitation, or other use of any materials that are similar or identical to the ideas, themes, formats, style, characters, plots, titles, concepts, branding elements, or other components contained in your Submission, including claims for copyright infringement, breach of implied contract, misappropriation, or unfair competition; provided, however, that this waiver does not apply to any claim based on The Final Word’s direct, unauthorized use of your exact Submission materials beyond the limited license granted in Section 2.

5. EVALUATION PROCESS

The Final Word is under no obligation to review, respond to, or return any Submission. We reserve the right to reject any Submission for any reason at our sole discretion. We are not responsible for the loss or damage of any electronic files or physical materials submitted.

5A. DATA PRIVACY AND SECURITY (PITCH DECKS, VIDEOS, AND FILES)

5A.1 Handling of Materials: We will use reasonable administrative, technical, and organizational measures to help protect Submissions (including pitch decks and videos) submitted through our website, Wix forms, or other designated channels. However, no system is completely secure, and you submit at your own risk.
5A.2 No Sensitive Personal Data: Do not include sensitive personal information (e.g., Social Security numbers, government ID numbers, financial account numbers, health information) in any Submission.
5A.3 Storage and Access: Submissions may be stored and processed in systems operated by The Final Word and/or third-party service providers (including Wix and file hosting/email providers) for purposes consistent with these Terms. Access may be provided to our personnel and advisors on a need-to-know basis for review and administration.
5A.4 Retention: We may retain Submissions for as long as reasonably necessary for evaluation, recordkeeping, dispute avoidance, and business purposes, unless otherwise required by applicable law.

7. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

8. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and The Final Word regarding Submissions and supersede all prior or contemporaneous communications or agreements. Any modification to these Terms must be in writing and signed by an authorized representative of The Final Word.
